Q: Senate President Enrile, sa issue po ng nangyayari ngayon sa C-5, ito po ang malimit naming tinututukan dito.

JPE: Sabi nga ng iba diyan, C-5 at taga raw. Alam mo, itong si Manny Villar ay gustong pagtakpan itong ginawa niya. Siya ang promotor ng dalawang kalye. Siya ang promotor ng C-5 extension. Pinalitan niya ang alignment noong C-5 Link Expressway na ikakabit doon sa Macapagal Avenue. Inilihis niya para pumunta sa mga lupa niya sa pagitan ng Multinational at Sucat hanggang doon sa Quirino Avenue sa Las Piñas na kung saan napakadami ng lupa niya. Siya ang nagpondo. Siya ang kumuha ng pera sa budget upang pondohan ‘yon. Pati yung Php30 million para sa irigasyon ng mga farmers sa Cagayan na inilagay ko sa budget, kinuha niya at ginamit niya noong siya ang Chairman ng Finance Committee para doon sa C-5 project niya. At dahil diyan, kumita siya ng limpak-limpak na salapi na ngayo’y ginagamit niya upang siya’y maging sikat na kandidato sa pagka-Presidente. Kaya sabi ko, mahirap itong si Manny dahil binibili niya ‘yung kapangyarihan niya sa pagka-Presidente niya.

Q: ‘Yan ba ang takbo niyo rito sa issue na ‘to? Ako’y nagtataka kung bakit naman tuluyang nagkikibit-balikat na lang at hindi humaharap dito sa Komite na nagdidinig sa kasong ito.

JPE: Alam mo Jun, ‘yung manok kapag nasa galyera, kahit hindi lumalaban ay talo. Di ba? ‘Yung tandang na ilalaban sa pintakasi, na hindi lumalaban siya ang talo.

Q: Mayroong text po sa atin Senador, ito po bang pagkakabunyag sa Senado ay masasabi niyo po ba sa ating mga kababayan na talagang kayo at tinangkang suhulan ng ating promotor ng C-5 Extension Road ?

JPE: Totoo ‘yon, Jun. Maisusumpa ko sa buhay ng aking mga anak na totoo ‘yon na sinabi ni Manny Villar. Ewan ko lang kung maisusumpa niya sa buhay ng kaniyang mga anak na hindi totoo ang sinabi kong ‘yon. Mayroon akong testigo na makapagpapatunay na nagsisinungaling siya kung sinasabi niya na hindi niya sinabi ‘yon.

Q: I understand ho, Senador. Pero ngayon po ay pinasisinungalingan po ito nitong si Sen. Manny Villar. Sa katunayan nga, ang nagpapatunay nito ay ang kanyang endorser na si Dolphy na malinis ito, walang ginagawang masama, hindi nagnakaw. Ano po ang masasabi niyo rito?

JPE: Ewan ko lang kung inimbestigahan ni Dolphy ‘yung C-5 at saka ‘yung mga Camella, Palmera na mga bahay na pinagbili ni Villar. Maraming umaangal. Maraming mga tao na ang nagpupunta sa Senado at sinasabing ang mga bahay daw nila ay walang mga haligi. Bumabagsak.

Q:        Ako naman po ay nalulungkot dahil sa Senado po ngayon kung bakit nagkakaganito ang mga halal ng bayan.

JPE: Nakakalungkot nga. Ako naman ay tahimik lang na tao. Sa totoo lang, nagkamali si Manny Villar. Tinanggal niya kay Ping Lacson ‘yung imbestigasyon. Sana pinabayaan niya kay Ping Lacson, hindi abogado si Ping Lacson. Hindi siya sanay na magsuri ng ebidensiya na ipiniprisenta sa kanya. At pwede niya sabihing may motibo si Ping Lacson dahil kandidato noon si Ping Lacson sa pagka-presidente. Pero ako, ako ay ginawang Senate President. Hindi ko hiningi ‘yong trabaho na ‘yon. Ginawa nila akong Chairman ng Committee of the Whole para bigyan siya ng patas na laban.

Q: So ibig sabihin ba noon, pinahina niya ang kanyang pwersa diyan sa Senado?

JPE: Tama ‘yon at saka ang nangyayari ngayon ay parang ako ang kumakandidato ng pagka-Presidente at ako ang nilalabanan ni Manny Villar. Ako ay kumakandidato lang ng pagka-Senador. Baka gusto niyang kumandidato ng pagka-Senador? Pwede kaming mag-debate. Ayaw niyang makipag-debate. Ang ginagamit niya, ‘yung kanyang mga bukadora. Mayroon siyang mga bukadora. Maiinit ang ulo ng kanyang mga bukadora. Gumagamit sila ng mga maaanghang na salita doon sa kanilang mga kalaban. Ibig sabihin noon, kulang sila sa argumento. Sabi nga sa mga abugado, kung malakas ka sa facts sa kaso, pukpukin mo sa facts. Kung malakas sa batas, pukpukin mo ‘yung batas. Kung hindi ka malakas sa batas at facts ng kaso, pukpukin mo ang lamesa. Kaya ang ginagawa nila ngayon ay pinupukpok nila ang lamesa.

Q: Ano naman ang sinasabi niyo diyan na kaya raw umuusok ang inyong bumbunan at hawak-hawak niyo ang gavel, may tumatangka na agawan daw kayo ng posisyon. Sinasabi pa rin na kayo raw ang nagsabi na mayroon nang namumuno dun sa Senado para may kudeta.

JPE: Alam mo Jun, ako ay sanay sa kudeta. So, handa ako sa mga kudeta na ‘yan. Ang lumalabas ngayon ang ginagawa nila ay kudeting.

Q: Well, dito pa rin siya isyu na ito—itong napakalaking C-5 na ito na ang promotor nito ay itong si Manny Villar. Sinasabi raw niya na halos walang makapagsabi kung talagang ‘yung mga lupang dinaan niyan ay puro sa kanya.

JPE: ‘Yung Adelfa Corp. 52 percent ‘yung hawak niya diyan. ‘Yung asawa niya 48 percent.  Pagsamahin mo ‘yung dalawang figure na ‘yon, 100 percent na hawak nila ang korporasyon. At ‘yung mga korporasyon na ‘yon meron namang mga korporasyon na ‘yon may hawak na korporasyon ‘yung Golden Haven na ang daming lupa dun. Meron sigurong kulang-kulang na 60 hectares na lupa ‘yung kanyang Brittany . Ganoon din, ang daming lupa. Doon sa kabila ng Sucat kung alam niyo ‘yung Sucat Road , pagitan ng Sucat at Multi-national, kabi-kabilaan ang dinadaanang kalye na ginawa niyang daan niya. Ngayon, akalain mo itong kalye na dapat ay straight para makatipid ang gobyerno ay lumiko. Paliko-liko para dun sa lupa ni Manny Villar. Kaya sabi ko nga, ang galing naman ng mga nandito sa Vilar side. Paliko-liko na ‘yung ginawa nilang kalye. Paliko-liko rin ang kanilang argumento para gumaan ‘yung usapan nila sa kanilang panig.

Q: Pero Senador, meron ba talaga tayong patunay diyan na itong mga lupang ito na parang dinaanan ng sawa ay puro kanya?

JPE: Oo. Meron ding mga tao na may dinaanan na kalye na katabi ng mga lupain niya. Ang misteryo diyan, ang lupa  niya mataas ang presyo pero ‘yung katabi, ‘yung karatig na dinaanan din ng kalye ay mababa. ‘Yung karatig ay P4,000 per sq. m lang, ‘yung kanya ay P20 million per sq. m.

Q: Halimbawa bumaba ang pagdinig nito sa Senado ay mapatunayang guilty nga itong ating Sen. Manny Vilar na ngayon ay nahaharap sa paghahatol ng ating mga kababayan bilang president ng ating bansa. Ano ngayon ang mangyayari sa kanya?

JPE: May ebidensiya nga. Ayon sa ebidensiya, guilty.

Q: So ano po ngayon ang mangyayari?

JPE: Magbobotohan.

Q: So sakali nga po ngayon kung mapatunayan nga ang mga nangyari kay Villar?

JPE: Magpapatuloy pa rin siya na Senador pero pagsasabihan mo lang siya na wag mo nang uulitin ‘yan. Kung uulitin naman, sasabihan naman ang taong bayan. Sabihan mo ang mga kapwa mo Senador para alam nila na ‘yung kinukuha mong pera sa budget na ginagamit mo sa proyekto na ‘yan ay may pakinabang ka.

Q: Akala ko ipapakulong niyo.

JPE: Ay hindi. Iba na ‘yun kung sa korte na ‘yun, pwedeng makulong.

Q: Well, ano naman ang masasabi niyo sa inasal ng ating magaling kahapon diyan itong Senador na hinahangaan ko na matapang na si Sen. Miriam Defensor-Santiago?

JPE: Alam mo Jun, ako’y takot dun sa Senadora na ‘yun eh. Nung ako ‘yung magtalumpati sinasabi ako raw ay nambabastos. Ang sabi ko lang ay hindi niya napag-aralan ‘yung nangyari sa Senado natin na ako mismo ay na-censure na napahiya siguro siya dahil hindi niya napag-aralan ‘yun kaya pumutok ang kanyang butsi at umusok ang kanyang utak kaya nagsisisigaw dun sa Senado at hindi niya pinag-aralan ‘yung record ng US Congress kung saan natin kinopya ang Saligang Batas natin at doon ang mga Senador kapag expulsion o suspension, 2/3 ang vote. Kapag censure, majority lamang.  Kaya sinabi ko, kung inaakala mo na iniinsulto  kita ay magsamapa ka ng kaso sa husgado at haharapin kita doon.

Q: So doon natapos ‘yon?

JPE: Oo, doon natapos ‘yon. Ako Jun, hindi ako nagwalk-out, nagpunta lang ako sa kasilyas.

Q: Senador Enrile, hawak niyo po ngayon ang mga isinumiteng ebidensiya ng reklamo kay Senador Villar. Sa tingin niyo po ba ngayon ay ito ay substantial nang naglabasan?

JPE: Kung isasampa mo ang kaso sa husgado, siya ay papasok sa bilangguan. Gusto ko lang sabihin na nalulungkot ako sapagkat ‘yung Senadora na tinutukoy mo, inaanak ko sa kasal ‘yon. Ninininong-ninong niya ako pagkatapos ako ang unang nagbigay sa kanya ng trabaho noong siya ay bagong graduado sa Unibersidad ng Pilipinas at ako ang Secretary of Justice. Pero ako naman, ako naman ang pumigil sa kanyang confirmation noong siya ay ginawang Secretary of Agrarian Reforms ni Cory Aquino dahil tungkol sa isang kotse na kinuha na pag-aari ng ibang tao. Alam mo naman Jun na ako’y hindi nagyayabang na abogado. Hindi ko sinasabi na ako  ay magaling na manananggol pero sa examination ay 92 percent ang average ko pero may iba diyan na halos bumagsak.###

CHARGES:

Conflict of interest


ACTS CONSTITUTING CHARGES:

1. SP Villar caused the diversion of C-5 Road Extension project to pass through the properties owned by Villar’s corporations. (EVIDENCE: Project Profile)

2. At least 12 properties of Villar’s corporations with an aggregate area of more than two hectares were bought by the government as roads right of way in the project Villar diverted. (EVIDENCE: List of affected lots)

3. Villar negotiated with the government for the sale of the properties in the project he proposed. (EVIDENCE: Project Profile states “The city government of Las Piñas together with the Staff from the Office of the proponent have negotiated the lot with owners affected by the RROW.”)

4. Properties of Villar’s corporations were bought at a grossly overpriced amount. For example, property of Brittany Corporation (a corporation controlled by Villar) was bought for P15,000/square meter while adjacent property owned by the Plaza family was bought for only P4,000/square meter. (EVIDENCE: Deed of sale of Brittany and RP, Deed of sale of Plaza and RP, BIR zonal valuation, tax declaration)

4. Villar’s PDAF/pork barrel was used to purchase roads right of way (as shown by the DBM allocation to Villar’s PDAF for the construction of the C-5 Road extension, including purchase of right of way). (EVIDENCE: DBM PDAF release)

5. Villar connived with Masaito Development Corporation to grossly overprice the sale of Masaito’s property to the government for right of way in the staggering amount f P30,000 per square meter.”

LAWS VIOLATED:

Art. VI, Sec. 14, Constitution prohibiting any senator from, directly or indirectly, being interested financially in any government contract during his term of office.

Art. VI, Sec. 12, Constitution requiring all members of Congress to notify the House concerned of a potential conflict of interest that may arise from the filing of a proposed legislation.

Art. 7(a), Code of Conduct and Ethical Standards of Public Officials and Employees prohibits public officials from having any financial or material interest in any transaction requiring the approval of their office.

When the Senate Committee of the Whole resumes this morning its hearing on the conflict-of-interest case filed against Sen. Manuel “Manny” Villar by Sen. Jamby Madrigal, it is back to square one with the minority refusing to take part in the proceedings.

The Senate has constituted itself into the Committee of the Whole precisely to ensure that the minority would participate in the hearing of the case.

But even without the presence of the minority, Senate President Juan Ponce Enrile has moved to proceed with the twice-a-week hearing of the case for as long as there is a quorum.

Under the rules adopted by the Senate Committee of the Whole, the presence of two senators is enough to constitute a quorum. The majority has rejected the proposal of the minority to peg the quorum at one-half plus one of all members because of the difficulty of meeting that requirement.

Sen. Joker Arroyo appealed in vain for the higher quorum requirement. He said that since the senators will be judging the honor and future of a colleague, they should attend all hearings.

Under oath

Enrile had warned that Villar would be greatly disadvantaged should he refuse to participate because the Committee would only consider the side of Madrigal that is given under oath. He said that the Committee would not give any cognizance to statements of Villar in his defense outside the committee because these are not made under oath.

The general counsel of the committee will present at the hearing today a summary of the supposed evidence and documents submitted by lawyer Ernesto Francisco, Madrigal’s counsel, at the preliminary inquiry of the case last Thursday.

Francisco claimed they could prove that Villar caused the diversion of the C-5 Road extension project to pass through the properties of his corporations, “thus wasting P1.2 billion already paid for Right of Way.”

Realignment

Villa later replied in a press conference that the charge of “realignment” would be dismissed outright if they acknowledge that two separate projects are involved—the C-5 road extension project and the Manila-Cavite Toll Expressway project of the Toll Regulatory Board and implemented by the UEM-Mara Philippines.

“The P1.2 billion was at the toll road, a private project, which could not be diverted. The C-5 road extension, free to the public, followed the original route except for the location of one bridge,” he said.

He added that the “slight” shift in the centerline of the said bridge was made upon request of the Light Rail Transit Authority that had plans of using the route also.

“There was no bending of the route. What was bent was the truth,” Villar said

Overprice

Madrigal’s lawyer also claimed that Villar’s property was paid P30,000 per square meter while a nearby pro­perty belonging to Rep. Democrito Plaza 2nd of Agusan del Sur was paid only P4,000 per square meter. He charged that Villar “secretly connived with Masaito Development Corp. in 2004 to grossly overprice the sale of Masaito’s property to the government for right of way in the staggering amount f P30,000 per square meter.”

“He demanded that the overprice be directly paid to him and even put this provision in writing,” Francisco said.

Villar said that the P30,000 referred to a 1,400-square meter lot located near the SM mall and alongside Sucat Road. He said that considering its location, the price of P30,000 per square meter was even low.

“I doubt if you could buy the same lot for P30,000 per square meter,” he added.

He said that the lot of Plaza valued at P4,000 per square meter was in the interior, far from the 1,400 square meter lot.

Public road

He contended that no real estate developer wants public road to pass through his or her property because this would lower its price. He declared that anybody who would want to build a public road pass on any Ayala property would be rejected.

Villar, however, would not say part of his property was traversed by the C-5 road extension project. He said he still had to consult with his lawyers about this.

Madrigal’s complaint also included the alleged double insertion of P200 million for the C-5 road extension project by Villar in the 2008 budget. Villar said this was already investigated by the Senate Committee on Finance, which found no anomaly.

If adjudged guilty by the Senate Committee of the Whole, Villar could be reprimanded, suspended or ousted. A two-thirds vote of the Senate is needed to suspend or oust a senator.

Villar said he is prepared for whatever decisions the Senate has in store for him.

C5 at Taga: Villar, Tunay na Pahirap!

Ginamit ang kanyang poder bilang senador para ilihis ang C5 at dumaan sa kanyang subdivision.

Nagpuslit ng pera si Villar sa budget para bayaran ang mga lupain niya.

Ginamit ang impluwensya para i-overprice ng 141 milyong ang halaga ng mga lupaing binili sa kanya ng gobyerno.

Sinayang niya ang 1.8 bilyong piso na dati nang nabayaran ng gobyerno bilang road right of way dahil inilihis niya ang C5 para makinabang ang mga lupain niya.

Duwag siyang humarap sa Senado upang ipaliwanag ang mga paratang sa kanya.

Tinangka niyang suhulan si Senate President Juan Ponce Enrile para hindi nito ilabas ang ulat ng Senado tungkol sa mga kabalbalang ito.

Dahil sa mga ginawang ito ni Villar, nawalan ng 6.22 bilyong piso ang gobyerno, pera na nakapagpatayo sana ng 10,366 na classroom para sa kabataang Pilipino. Ito ba yung dapat nating “malaman na mapapag-aral niya tayo?”

Ang P6.22 bilyon ay makakapagpatayo sana ng 8,293 na bahay para sa mga mahihirap nating kababayan. Ito ba yung”pangarap niyang magkabahay tayo?”

Ang perang kinubra niya ay makakagawa ng 125,000 na trabaho para sa mga maliliit na negosyo. Ito ba ang sinasabi niyang”tutulungan tayong magtrabaho?”

Villar should be prosecuted for plunder

” Those who have no sin, let him cast the first stone,” said Jesus Christ when he spoke before a throng of Jews who accused a woman of adultery. No one threw a stone nor a pebble.

It is in this context that I ask Senators Jamby Madrigal and Ping Lacson–can you possibly say with all honesty that you did not use your power to influence any activity in government? Did you or did you not, in one instance or another, use your influence to push for a project?

Yes, they would probably tell me. Yes, there are instances where we used our standing to push for a project. But, this is different, Pat. We are casting a stone against Senate president Manny Villar because he used his influence to gain more money from his projects. We pushed for projects using our influence, yes, but we did not gain a single cent from it.

Imagine, Senator Enrile categorically saying that Villar did, indeed, requested for a double insertion in the C-5 project. Yes, Villar did that, and the good senator admitted it. He did push for that project because it would benefit his constituents. Yes, they will gain from the C-5 project, I agree, Mr. Villar. They’ll benefit from a flyover without a road. They’ll benefit from it, especially those living in your subdivisions.

Who pushed for the c-5 project to pass the properties of Brittany and Vista Land? Villar. Who gained from selling “right of way” properties worth 1,500 per square meter to 15,000 per square meter? Villar. And who’ll amass billions of billions of pesos from that C-5 extension road? Villar.

Madrigal and Lacson are right–this is not a political issue. No. This is plain and simple corruption or plunder even. Villar should be cruxified and jailed.

Erap and Jinggoy are laughing right now. Remember that Villar banged the gravel when he was Speaker of the House, after accusing Erap of plunder. Erap is now free, and those who accused him of crimes against the people, are those who are now being accused of the same. And this time, there’s no Jose Velardes.

Those who have no sin, let him cast the first stone.

Manny Villar not cleared of C-5 road scam: Resolution 1472 junked due to alleged “fraud”

How transactional Philippine politics is, you ask Mang Isko? I will refer you to Senate Resolution 1472, that piece of document purportedly signed by twelve “See-Nay”-tors and allegedly cleared the name of Nacionalista party president bet and billionaire Senator Manny Villar.

The Resolution, which was purportedly written and pushed by no less than Liberal Party member Francis “Kiko” Pangilinan, expressed the “sense of the Senate” and bore the signatures of Aquilino Pimentel Jr., Alan Peter Cayetano, Pia Cayetano, Lito Lapid, Gregorio Honasan, Joker Arroyo, Miriam Defensor-Santiago, Ramon Revilla, Jinggoy Estrada, Loren Legarda, Francis Pangilinan and Villar.

The “see-nay” tors who signed based their “sense” on oral testimony instead of overwhelming documentary evidence linking Villar to the mess which was presented before the Senate of the Whole.

Resolution 1472 was released to the media a few days before yesterday’s (November 17) announcement of the Villar-Legarda tandem. It had impeccable timing. Yet, like all dastardly deeds, it stinks to the highest heavens.

Shortly after it was released, Senate president Juan Ponce-Enrile was apprised of the sneeky reso and threatened to resign. His colleagues prevailed him.

Eventually, Enrile learned that there was an element of deception here. Most of those who signed the Reso, omitting of course the familiar names of Pimentel, the Cayetano siblings, Pangilinan, Joker and Jinggoy and of course, who else but Loren, are claiming that they signed the reso purportedly after being told that it has the expressed support of the Senate president.

Enrile denied supporting Resolution 1472 which he, in fact, viewed as a direct affront to his leadership. That Reso, says Enrile, violated Senate rules and smacks of fraud. And who else to defend it but the venerable See-nay-tor Francis Kiko Pangilinan, whom pundits say, was the one who lobbied the others to sign.

Strange that a non-Nacionalista party member would push for a Resolution exonerating Villar when it is clear in the Senate rules that it is now the Senate of the Whole who will release the final report on the C-5 controversy.

Wagging tongues cannot but say that maybe Resolution 1472 was an “exchange deal” between the Nacionalista and the Liberal Party, ahead of the expected filing of an ethics case against Liberal Party presidential bet Noynoy Aquino, this time, on another “C-5″-like road controversy involving of course, the conversion of hectares of land in Hacienda Luisita for SLEX.

Remember that it was Cong. Crispin Remulla, a Nacionalista, who “exposed” the supposed complicity of Senator Aquino in that alleged overpricing of Hacienda Luisita land used for SLEX.

Seems like the Nacionalistas used Remulla’s expose as a “bait” for the Liberals to enter into an “exchange deal”–tit for tat—your overpriced C-5 in exchange for my overpriced SLEX. Sounds logical right? And with a Liberal (PANGILINAN) leading the pencil pushing and lobbying, all the more suspicious.

And it seems like the Nacionalista got Loren Legarda not because the beautiful environmentalist shares a common goal with their presidential bet Villar. Legarda was one of Villar’s rabid commenter at the Senate. And Legarda admitted that it was “all for show”, part of the “daily grind” of “usual questions”, of “common parliamentary debates”.

Statements such as these can’t prevent one from asking—did Loren baited Villar to make her his VP in exchange for one signature in that Resolution? That signature might have cost Villar a hand and a limb. Such political prostitution extraordinaire, if you ask me.

The sad thing about this—that Reso 1472 was junked. And the obvious loser was of course, Manny Villar, who mobilize all his resources just to make that Reso happen. Poor Manny. He tried to sneak himself out of the C-5 mess only to learn that, in the end, he still stinks and worst, left holding an empty bag (of tricks?).

As they say, when it stinks, it stinks really bad.
